1. The parties
Arcane Tech SRL, hereinafter “Arcane Tech”, “we” or the “trader”, with its registered office at Strada Avrig no. 11-19, bl. 15, et. 3, ap. 7, postal code 310147, Arad, Arad County, Romania, registered with the Trade Register under number J2024/02376/2024, EUID ROONRC.J2024023761001, sole registration code (CUI) 50575080, share capital 200 RON, email office@arcanetech.ro, phone +40 741 526 332.
The User, a natural or legal person, who accesses the Arcane Tech site (the arcanetech.eu and arcanetech.ro domains, which serve the same content identically) or who contracts services with Arcane Tech.
This identification information is provided in accordance with Romanian Government Emergency Ordinance No. 34/2014 on consumer rights and with Government Emergency Ordinance No. 49/2009 on electronic commerce.
2. Subject matter
This document sets out the conditions for using the Arcane Tech site, accessible on the arcanetech.eu and arcanetech.ro domains, as well as the general principles applicable to the service contracts concluded with Arcane Tech. The specific terms of each project are set out in a separate written contract, which prevails over these general conditions.
3. Language of the site
The site is available in Romanian and English. On your first visit, the language is selected automatically based on the country you are visiting from, derived transiently from your IP address, without storing it. You can change the language at any time from the switcher in the site header, and your choice takes precedence. The details of this processing are described in our privacy policy and in our cookie policy. In the event of a discrepancy in interpretation between the language versions, the Romanian version prevails.

5. The contracting process
Contracting a project follows these steps: a request through the contact form or by email, a technical briefing, a written offer, signing the framework contract and the project-specific annex, payment of the advance where applicable, and the start of execution. Email communications are valid only for operational clarifications; they do not replace an amendment to the written contract.
6. Prices and payment
Prices are expressed in EUR or RON, exclusive of VAT, as expressly stated in the offer. VAT is added in accordance with the legislation in force. The default payment term is 14 calendar days from the issue of the invoice. Late payments incur a penalty of 0.1% per day of delay, without the total exceeding the outstanding debt.
7. Delivery and acceptance
Delivery deadlines are set in the contract. Each deliverable is accepted within a maximum of 10 working days from the delivery notification. The absence of a written response within that period amounts to tacit acceptance.
8. Right of withdrawal
Arcane Tech services are made-to-order digital content and software services, personalized to the consumer's specifications. For these services, the 14-day right of withdrawal provided by Government Emergency Ordinance No. 34/2014 does not apply, on the basis of the exceptions in Article 16(a), (c) and (m) of that ordinance (services fully performed with the consumer's prior agreement, personalized goods, and digital content not supplied on a tangible medium, respectively). These conditions are set out explicitly in the signed contract.
9. Intellectual property
The source code, design deliverables and documentation related to a project belong to the client from the moment of final acceptance and full payment, in accordance with Romanian Law No. 8/1996 on copyright. Arcane Tech reserves the right to use generic solutions, reusable components and technical know-how for later projects. The brand, the visual identity, the content published on the arcanetech.eu and arcanetech.ro domains, as well as the published case studies, belong to Arcane Tech and are protected under Romanian Law No. 84/1998 on trademarks.
10. Confidentiality
The parties mutually undertake to keep confidential the business, technical or commercial information exchanged during the collaboration. This obligation remains in force for 5 years after the contract ends. The details regarding the processing of personal data are set out in our privacy policy.
11. Warranty and maintenance
Applications developed by Arcane Tech benefit from a 60-day warranty from final acceptance for code defects or configuration errors attributable to us. The warranty does not cover: later modifications made by third parties, changes to the hosting environment, changes to functional requirements, or external attacks.
Post-warranty maintenance is available through a separate recurring services contract, with an agreed service level (SLA) and release windows.
12. Limitation of liability
Arcane Tech's liability for any direct damage attributable to its fault is limited to the contractual value actually paid for the relevant project over the last 12 months. We are not liable for indirect damages, loss of profit, business interruption or reputational damage.
13. Use of the site
The User undertakes not to: (i) fraudulently access the site's systems, (ii) inject code or scripts, (iii) use automated bots for mass content extraction, (iv) reproduce content without Arcane Tech's written agreement, (v) submit false information through forms. Breach of these obligations may give rise to civil and criminal liability.
14. Force majeure
Neither party is liable for the non-performance or late performance of contractual obligations if these are caused by events of force majeure, in accordance with Article 1351 of the Civil Code. The affected party will notify the other party within a maximum of 5 working days from the occurrence of the event.
15. Amendments
Arcane Tech reserves the right to unilaterally amend these general conditions. The applicable version is the one in force at the time the site is accessed or, as the case may be, at the time a contract is signed. Amendments take effect upon publication on this page.
16. Governing law and dispute resolution
This document is governed by Romanian law. Any disputes will be resolved amicably. Failing that, jurisdiction lies with the courts at Arcane Tech's registered office.
For consumers, there is the option of resorting to alternative dispute resolution: CSALB and the European Commission's ODR platform ec.europa.eu/consumers/odr. Details about consumer rights on the ANPC website (the Romanian National Authority for Consumer Protection).
